MWHOA Covenants - Compliance Process - November 2024

Dear Magnolia Walk HOA Member
 
As is allowed under the By-Laws, the Magnolia Walk Board of Directors has updated the procedure to enforce the HOA’s Covenants, By-Laws and Rules that govern our community.
The procedure gives more flexibility for compliance while putting more transparency in the process. 
The updated process consists of:
  1. Warning Notice – Homeowner receives a Warning Notice via e-mail[i]. Homeowner has 10 days to correct and notify the Board.
  2. Violation Notice – Homeowner receives a Violation Notice for failure to comply with step 1 above.  Homeowners will have 10 calendar days from the date of the Violation Notice to notify the HOA Board of the proposed corrective action and completion date.
  3. Fine Notice - Homeowner receives a fine notice for $25 per day per violation for failing to notify the HOA Board of the corrective and completion date required in the Violation Notice. The Homeowner will have 10 days from the date of the Fine Notice to pay the fine and resolve the issue. Failure to pay the fine and correct the violation within 10 days may result in the suspension of HOA membership, placing a lien on the property and/or referred to our contracted law firm of Lazega & Johanson LLC for future handling.
To assist in this process, we ask you to review the HOA Covenants, By-Laws and Rules found on our website under Members/Member Documents and familiarize yourself with the areas and issues that Board members will be looking for during routine inspections of properties.
