Proposed Rezoning from R-100 to R-TH for Track of Land Across from Magnolia Walk Subdivision – Case Number RZM2024-00004 - Update 6/3/2024.

This is a follow up to our last update of May 2, 2024.
We wanted to thank the Magnolia Walk homeowners that attended the Gwinnett County Board of Commissioners public hearing on May 14, 2024. Magnolia Walk HOA Board members Otis Brinson, Alan Polson and Paul Vasquez were also in attendance. Our attorney Jonathan Benator, did a good job in representing us and presenting our opposing arguments during the hearing despite the fact that the Planning Commissioners voted to approve the application for rezoning with conditions. One key condition recommended by the Planning Commission was to reduce the density to 85 units (21 homes and 64 townhomes). Our opposition to the construction of townhomes has been consistent from the beginning of the rezoning process. We oppose the construction of townhomes and prefer the construction of single-family detached homes. The initial proposed development plan consisted of 126 townhomes. Since then, the developer and landowner have revised their development plans to 113 units (17 homes and 96 townhomes), then to 92 units (21 homes and 71 townhomes) and now to 85 units (21 homes and 64 townhomes). During the public hearing on May 14th, the Gwinnett County Board of Commissioners voted to table our case to the June 4, 2024, public meeting. We believe that our case was tabled to allow the Commissioners more time to better understand what policies within the Gwinnett County 2040 Unified Plan vs 2045 Unified Plan, apply to the proposed development. This was evidenced by the type of questions raised by Commissioners Ku and Watkins. This means that the Commissioners will vote again on June 4th, to approve the request for rezoning with current or more conditions, deny or table the case again.
Today, June 3, 2024, the Magnolia Walk HOA Board of Directors met with Commissioner Kirkland Carner to thank the Commissioner for his time to talk to us and remind him that we oppose the construction of townhomes and prefer single-family detached homes, and requested that the application for rezoning from R-100 to R-TH be denied. The County zoning attorney also participated in the meeting. We provided Commissioner Carner with a rough cost analysis comparing the estimated construction cost and projected sale value of 85 units (21 homes and 64 townhomes) versus 60 single-family detached homes. The cost analysis shows that the construction of detached single-family homes is more cost effective. Commissioner Carner stated that he has not made a decision and wanted to have a conversation with planning commission senior staff and other Commissioner before taking the vote tomorrow. He clarified that the Board of Commissioners will vote during their Business Meeting scheduled for tomorrow Tuesday, June 4, 2024, at 2:00PM, at the Gwinnett Justice & Administration Center Auditorium 75 Langley Drive, in Lawrenceville.
